Limited Divorce
A Limited Divorce is a court ordered separation. Your marital
relationship is not terminated; you are still married. In order
to be awarded a Limited Divorce, you must meet certain criteria
(e.g. (1) desertion; |
 |
|
(2) cruelty of treatment/excessively vicious conduct by your spouse toward
you or your child; (3) continuous voluntary separation if
there is no reasonable hope of expectation). As part of this
proceeding, the court can make some decisions concerning children,
support, property and health insurance.
Absolute Divorce
An Absolute Divorce is a termination of your marriage; you
are no longer married. In order to be awarded an Absolute
Divorce there are certain criteria to be met. Some of the
more common grounds for divorce are (1) adultery by your spouse
(providing that you are not committing adultery too!); (2)
desertion by your spouse that has continued uninterruptedly
for 12 months; (3) voluntary and mutual separation that has
continued uninterruptedly for 12 months if there is no reasonable
expectation of reconciliation; (4) or a separation that has
continued uninterruptedly for two years. As part of this proceeding,
the court can make decisions concerning children, support
and health insurance and it can make a final disposition of
your property.
